Passterity LLC ("Passterity", "we", "our") is a California‑based company that provides a post‑humous messaging platform exclusively for estate planning attorneys and trust companies ("Partners"). Our services enable Partners to offer secure, encrypted legacy communication to their clients.

2. Information We Collect

From Partners – business name, billing contact information, email address, and payment details necessary for invoicing.

From End‑User Clients – name, email address, relationship to the deceased, and the content of messages they create (text, email, and video files). We also collect metadata such as timestamps and delivery preferences.

3. How We Use Information

  • Provide and maintain the Service for Partners and their clients.
  • Process billing and subscription invoicing via Stripe.
  • Send transactional emails (e.g., verification, delivery confirmations) via SendGrid.
  • Support Partner‑specific reporting and compliance needs.
  • Improve the platform and ensure security.

4. Data Sharing

Partners receive only metadata about their own clients (e.g., delivery status, timestamps). Message content, video files, and personally identifying information are never shared with Partners.

Third‑party processors:

  • Stripe – payment processing; we share name, email, and billing details.
  • SendGrid – email delivery; we share recipient email addresses and the message content at the moment of delivery.

5. Encryption at Rest

All client‑generated messages and uploaded video files are stored encrypted using industry‑standard AES‑256 encryption. Encryption keys are managed by our cloud provider and are never exposed in plaintext.

6. Data Retention

  • Message content and videos are retained until a delivery is triggered by the Partner, after which they are retained for seven (7) years.
  • Metadata and account records are retained for seven (7) years after account closure.

7. User Rights

Partners and their clients may exercise the following rights under GDPR, CCPA, or applicable privacy laws:

  • Access – request a copy of personal data we hold.
  • Deletion – request erasure of personal data.
  • Portability – receive data in a machine‑readable format.
  • Withdraw consent – revoke any consent provided for processing.

8. Cookies

We use session‑only cookies necessary for authentication. No tracking or advertising cookies are employed.

9. Children’s Privacy

The Service is not intended for individuals under eighteen (18) years of age, and we do not knowingly collect data from children.
