Terms of Service

1. Acceptance

Use of Passterity requires a partnership with a verified estate planning attorney or trust company ("Partner"). By accessing the Service, you (the Partner) agree to these Terms.

2. Service Description

Passterity provides a white‑labeled post‑humous messaging platform that Partners can offer to their clients. Messages are stored encrypted and delivered after a verified death event.

3. Eligibility

Clients may only join the Service through an invitation from a Partner. Public self‑sign‑up is not permitted.

4. Partner Obligations

• Verify client identity and maintain accurate contact information.
• Handle death verification in compliance with applicable law.
• Initiate message delivery lawfully using the provided partner API or dashboard.

5. Client Obligations

Clients must submit lawful content only. Prohibited content includes illegal, threatening, defamatory, or harassing material.

6. Liability

Passterity supplies the infrastructure. Partners are responsible for vetting clients and ensuring proper delivery verification. Partners indemnify Passterity against claims arising from client content or delivery actions.

7. Termination

• Partners may terminate any client’s account at any time.
• Passterity reserves the right to suspend or terminate service for violations of these Terms.

8. Limitation of Liability

Passterity’s total liability, whether in contract, tort (including negligence) or otherwise, shall not exceed the fees paid by the Partner in the twelve (12) months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the State of California, and any disputes will be resolved in the courts of Santa Cruz County.

10. Changes to Terms

Passterity will provide at least thirty (30) days’ notice of any material changes. Continued use after the notice period constitutes acceptance.
