1. Acceptance of Terms
By accessing or using Passterity ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. We reserve the right to update these terms at any time, and continued use constitutes acceptance of changes.
2. Description of Service
Passterity is a legacy message delivery platform that allows users to compose emails and (when available) video messages to be delivered to designated recipients after the user's passing. Delivery is triggered through a verified death notification process reviewed by our administrative team.
3. Eligibility
You must be at least 18 years old to create an account and use the Service. By registering, you represent that you meet this requirement and that all information you provide is accurate and complete.
4. Account Registration
- You must provide a valid email address and verify it before using the Service.
- You are responsible for maintaining the security of your password and account.
- You must notify us immediately of any unauthorized access to your account.
- Passwords must meet our minimum requirements: at least 9 characters, 1 uppercase letter, and 1 symbol.
5. User Content
You retain ownership of all content you create on Passterity, including:
- Legacy emails and their content
- Video messages
- Recipient information
By using the Service, you grant us a limited license to store, process, and deliver your content as necessary to operate the Service. We will never use your content for advertising, marketing, or any purpose other than providing the Service.
6. Acceptable Use
You agree not to use the Service to:
- Send threatening, harassing, defamatory, or illegal content
- Impersonate another person or misrepresent your identity
- Submit fraudulent death notifications
- Distribute malware, spam, or harmful content
- Attempt to access other users' accounts or data
- Circumvent security measures or exploit vulnerabilities
Violation of these terms may result in immediate account termination.
7. Death Notification Process
- Death notifications may be submitted by any person with knowledge of the account holder's passing.
- All notifications are reviewed by our administrative team before any messages are delivered.
- We may request supporting documentation to verify a death notification.
- We reserve the right to reject notifications that cannot be adequately verified.
- Submitting a fraudulent death notification is a serious violation and may have legal consequences.
8. Service Tiers
Free Tier:
- Up to 5 legacy emails
- Up to 2 video messages (480p, 50MB max each)
- Standard delivery
Premium tiers with additional features may be offered in the future. We will notify users of any changes to tier limits or pricing.
9. Message Delivery
- Messages are delivered only after a death notification has been submitted and verified.
- Only messages marked as "Ready" at the time of verification will be delivered.
- We make reasonable efforts to deliver messages but cannot guarantee delivery to all email addresses (e.g., if a recipient's email is invalid or their inbox rejects the message).
- Delivered messages include the sender's name and are clearly identified as legacy messages from Passterity.
10. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
11. Limitation of Liability
The Service is provided "as is" and "as available." To the maximum extent permitted by law:
- We do not guarantee uninterrupted or error-free operation of the Service.
- We are not liable for any failure or delay in delivering legacy messages.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
- Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
12. Account Termination
You may delete your account at any time. Upon deletion, all your content (messages, recipients, videos) will be permanently removed. We may also terminate accounts that violate these terms, remain inactive for an extended period, or are involved in fraudulent activity.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
